Shivon Zilis, a former OpenAI board member and Elon Musk's partner, testified in the lawsuit against OpenAI regarding structural decisions and conflicts of interest. Musk had proposed that OpenAI become a Tesla subsidiary, but leadership rejected this offer. Zilis left the board in 2023 after Musk founded xAI and began recruiting OpenAI researchers. She also testified about objecting to a potential OpenAI partnership with nuclear fusion startup Helion due to unproven technology. Musk's earlier departure from the OpenAI board in 2018 was partly motivated by concerns that Tesla and OpenAI would compete for AI talent, after Musk recruited a top researcher from OpenAI to Tesla.
