A San Jose man, Philip Ortega, has been charged with the murder of Baby Phoenix, who died from an opioid overdose linked to drugs he supplied to the baby's father. David Anthony Castro has also been charged with murder and felony child endangerment after his infant daughter's death from a drug overdose. Both cases highlight systemic issues regarding child safety and drug abuse. The District Attorney expresses a commitment to prosecute those responsible for these tragic deaths. Both suspects could face life in prison if convicted.
"The senseless deaths of these two little girls broke our hearts yet hardened our determination to hold responsible the people whose recklessness killed them," District Attorney Jeff Rosen said.
New evidence shows that Castro sought and Ortega provided drugs to Castro the night before his daughter was found dead in the home.
