"Sheriff Robert Jonsen said at a Tuesday news conference that a deputy, after initiating the stop, saw the driver acting erratically, and retreated and called for backup. Deputies, soon joined by the county's Psychiatric Emergency Response Team a unit that pairs law enforcement with mental-health clinicians sought to coax the man into surrendering peacefully, talking to him through the car and on his cell phone, Jonsen said."
"At one point, deputies fired pepper balls into the car make him come out. Jonsen said they initially thought that was going to work but that the scenario changed when the man emerged holding a kitchen fillet knife with an 8-inch blade. Deputies fired more pepper balls and rubber rounds at him to subdue him, Jonsen said, but the man instead got back into his car."
"When the man got out of the vehicle a second time, again holding the knife, and ran toward assembled deputies, two of whom opened fire, Jonsen said. He had plenty of opportunities to comply, exit the vehicle peacefully, be taken into custody, he said. Ultimately, he charged the deputies with the knife in hand, causing us to use lethal force."
A traffic stop for an undisclosed violation occurred just before 7:30 p.m. on Fruitdale Avenue near College Drive in West San Jose. A deputy observed the driver acting erratically, retreated, and called for backup. Deputies, joined by the county Psychiatric Emergency Response Team that pairs law enforcement with mental-health clinicians, attempted to coax the man into surrendering by speaking through the car and on his cell phone. Deputies fired pepper balls and rubber rounds; the man emerged holding an 8-inch kitchen fillet knife, charged toward deputies, and two deputies opened fire, killing him. The man’s name was not released pending formal identification and next-of-kin notification by the Santa Clara County Medical Examiner-Coroner.
