Nine First Nations in Ontario have initiated a constitutional challenge against federal and provincial laws that expedite infrastructure projects. The groups argue that these laws, specifically Bill C-5 and Bill 5, pose a direct threat to their self-determination and rights concerning their territories. Bill C-5 fast-tracks federal approvals while Bill 5 enables Ontario to create special economic zones exempt from existing laws. The Indigenous leaders are seeking a court injunction to prevent the implementation of these laws and protect their rights.
Bill C-5 allows cabinet to quickly grant federal approvals for big projects deemed to be in the national interest such as mines, ports and pipelines by sidestepping existing laws.
Ontario's Bill 5 allows its cabinet to suspend provincial and municipal laws through the creation of so-called 'special economic zones.'
The Indigenous communities say that both laws represent a 'clear and present danger' to their self-determination rights and ways of life on their territories.
The First Nations are asking the court for an injunction prohibiting the federal government from naming national interest projects and prohibiting Ontario from implementing special economic zones.
