Poland’s government plans to act quickly to comply with court rulings requiring legal recognition of same-sex marriages conducted in other EU member states. A same-sex couple, including a Polish citizen, was denied entry of a 2018 German marriage certificate into Poland’s civil registry. The case was challenged through Poland’s Supreme Administrative Court, which referred it to the Court of Justice of the European Union. The CJEU ruled in November 2025 that the marriage is valid across the EU and that Poland can recognize it without changing its laws to offer same-sex marriages domestically. In March, the Supreme Administrative Court ordered transcription of the certificate, leading to de facto recognition. Prime Minister Donald Tusk apologized for years of rejection and humiliation and said Poland lacks statutory regulations to ensure equal legal treatment.
