Appeals court greenlights suit alleging co-op discriminated against Black woman by selling to white man instead of her at last minute | amNewYork
"The Appellate Division, First Department agreed Tuesday with Forrester that her arguments were sufficient to constitute a discrimination claim and should be heard by a jury, overturning a New York Supreme Court decision dismissing the suit on the basis that she hadn't provided satisfactory evidence to warrant the discrimination case moving forward."
"Kareen Forrester, a Black nurse practitioner, had already signed a sale contract and made a down payment on a medical office space in a co-op located at 642 Park Ave. in 2023 when she was informed by Wellington Tichenor, the unit's owner, that he'd actually be selling the unit to a Glen Fuhrman, a white man on the co-op's board, was not a medical professional, and whose finances he allegedly did not review as extensively."
"She alleged the only reason she'd been passed up for the sale at the last minute was her race and gender and the co-op board and unit's owner simply wanted to block a Black woman from being in the building. She'd offered the asking price of $750,000, showed she had $1 million cash on hand, agreed to the financing requirements."
Kareen Forrester, a Black nurse practitioner, signed a contract to purchase a medical office space in a Manhattan co-op at 642 Park Avenue in 2023. After making a down payment, the unit owner Wellington Tichenor cancelled the sale and instead sold to Glen Fuhrman, a white man and co-op board member who was not a medical professional. Forrester alleged discrimination based on race and gender. A lower court dismissed her case, but the Appellate Division, First Department reversed that decision, determining her discrimination claims were sufficient to proceed to trial. Forrester had met all financial and contractual requirements and offered the asking price of $750,000.
