A former MDC Brooklyn guard is charged with illegally shooting at a BMW and wounding a backseat passenger after pursuing the vehicle in a Bureau of Prisons van off jail property. The officer described making a "split-second decision" on Sept. 4, 2023, and said he believed the incident involved a possible jailbreak and that he did not report the shooting or call 911 because he was in shock. The 23-year BOP veteran had been on perimeter duty during a heightened contraband alert, briefly left his post for a MetroCard and coffee, returned after radio clicks, and observed a sedan in the staff lot and a rope dangling from an upper level. Prosecutors challenged his training and the risks of shooting at a moving vehicle while driving.
