At an August preliminary hearing, the District Attorney's office announced it would seek voluntary manslaughter rather than a murder holding order for 25-year-old Alexander Northern. Northern was arrested in February and accused of beating roommate Wai Tsui during an argument about loud music after Tsui sprayed him in the face with cleaning chemicals. Witnesses and prosecutors emphasized large physical differences: Tsui was about 5'7" and around 150 pounds and over 25 years older, while Northern was at least eight inches taller and 75 to 100 pounds heavier. Tsui suffered fractured neck cartilage, liver hemorrhages and fractured ribs. Northern, who is autistic, told police he "snapped" after being sprayed and alleged Tsui brandished a wrench. The defense argued that police took advantage of Northern because of his autism.
