Two Italian brothers were awarded €95,000 each after a jury found they were maliciously prosecuted by gardai following a mistaken arrest over an alleged handbag theft in Dublin. The Court of Appeal dismissed an appeal against those awards. The brothers are Marco Gambucci, who runs a real estate business in Sardinia, and his brother Luca, a public servant in Perugia. The brothers sued two Pearse Street, Dublin-based gardai — then Garda, now Sergeant Daniel Barry and Garda Jonathan Petrie — as well as the Garda Commissioner and the State. The awards therefore remain in place.
