A federal judge ruled that New York's congestion pricing can continue without fear of federal penalties, blocking the U.S. Department of Transportation's threats. Judge Lewis Liman granted a temporary restraining order preventing any retaliatory measures from the federal government, citing the MTA's strong chance of winning its lawsuit against the Secretary of Transportation's authority to rescind approval. Liman emphasized that stopping tolling would cause irreparable harm to New York and malign state sovereignty by undermining elected decisions.
"Plaintiffs demonstrated likelihood of success on claims that the Secretary didn't have the authority to terminate the ... agreement," Liman said, reading from his ruling.
"This undermines the authority of a sovereign state to authorize policy decided on by its elected representatives," Liman said.
