A few minutes later, the three victims exited the elevator and Swygert and his group followed them to the main hotel lobby. Both groups left the hotel and words were exchanged between one of the victims and one of Swygert's companions. A physical fight ensued between the two groups."

On January 1, 2021, at approximately 1:09 a.m., Richard Swygert and others entered the Umbrella Hotel in Kew Gardens. After a physical altercation erupted between two groups in the hotel lobby, Swygert opened fire with a handgun. He shot 20-year-old Robert Williams five times fatally, fired six rounds at a 40-year-old man striking him in the stomach, arms, and legs, and shot a 20-year-old man once in the leg. Williams died from multiple gunshot wounds, becoming New York City's first recorded murder of 2021. The other two victims were hospitalized with serious injuries. Thirteen spent shell casings were recovered from the scene.
