Selling those items "in an area accessible to minors," according to the lawsuit, is illegal. The suit also describes an earlier investigation, conducted in April 2024 by the San Francisco Department of Public Health. There, an undercover "investigator purchased a POD Mesh Chilled Blue Razz vape styled flavored tobacco product," the sale of which is illegal in San Francisco."
"The store's owners had "no permit to sell tobacco at all," according to a spokesperson for the city attorney's office. "Not only were they selling tobacco, but they were selling flavored tobacco," which is not"
