"We live in a house built 40 years ago by the hands of our family, surrounded by our relatives, on land we've been on for three generations. We grow our own food and live a life we cherish on this land. This project and rezoning threaten not only our ability to exist here but also the meaningful existence of the community we love."
Southern Coalition for Social Justice and Southern Environmental Law Center filed a lawsuit in Stokes County Superior Court challenging the county's January 2026 decision to rezone approximately 1,845 acres of residential-agricultural land for heavy industrial use. The rezoning enables the "Project Delta" hyperscale data center complex and opens additional rural sites for potential future data centers. Plaintiffs include environmental and cultural nonprofits, residents, and families who have lived on the land for generations. They argue the county failed to follow required procedural safeguards, factual grounding, and reasoned decision-making under North Carolina law. The lawsuit seeks to strike down both zoning actions entirely, protecting the agricultural way of life and rural character that has defined the Dan River corridor.
