City Laws Look to Close Workplace Protection 'Loopholes' for App-Based Delivery Workers

The City Council approved new bills to enhance protections for all contracted delivery workers, including those delivering food and groceries. The legislation builds on 2021 laws that mandated studying pay and improving working conditions, resulting in a minimum wage of $17.96, effective December 2023. Two significant new bills close loopholes that previously excluded certain app delivery workers from minimum wage laws. The updates also require access to insulated delivery bags and other safety materials to enhance worker conditions.
The new package of bills applies to all contracted delivery workers, including those who deliver food, groceries, and other goods, and addresses pay, transparency, and safety standards.
Two new bills- Intro. 1133-A and Intro. 1135-A - close loopholes that excluded several app delivery workers from the minimum wage pay law that went into effect in 2023.
Intro. 1133-A requires DCWP to establish a minimum pay rate for all contracted delivery workers. It also expands other protections, like access to insulated delivery bags, fire safety materials, and hot food bags.
Grassroots organizers celebrated the legislation, which builds on a law passed in 2021 requiring the Department of Consumer and Worker Protection to study conditions and pay for delivery workers.
