Michael Proctor, an ex-State Police Trooper, failed to appear at a court hearing related to evidentiary delays in a murder case. Defense attorney Rosemary Scapicchio criticized Proctor for skipping the hearing, claiming he thinks he is above the law. Proctor sent his lawyer instead, stating he was on vacation. The court session also scrutinized prosecutor Adam Lally, who faced tough questioning about delays in providing key evidence in the case of Myles King, accused of murder. Scapicchio condemned the Commonwealth's handling of evidence as unconstitutional.
"Apparently, [Proctor] thinks he's above the law. He was served in hand. He was told to be here this morning. Instead, his attorney showed up and said he left on vacation on Saturday."
"The Commonwealth's failure to turn over this discovery in a timely fashion is inexcusable, inexplicable, and unconstitutional," she wrote in a May motion calling for the dismissal of King's charges.
"What happens when you ask for something, let's just say from the State Police, and they don't give it to you?"
