NWSEO and POPA filed a motion for a preliminary injunction in U.S. District Court for the District of Columbia on October 24 alleging Executive Orders Nos. 14,251 and 14,343 unlawfully threaten employees' rights to organize and bargain collectively. The unions asserted the orders do not address legitimate national security issues but instead retaliate against unions for representing employees. The unions asked the court to enjoin application and enforcement of the executive orders while the case is litigated and requested a hearing for November 13. POPA, representing USPTO patent examiners since 1964, filed a complaint after a pre-Labor Day EO that effectively bars USPTO patents employees from joining the union. The Order, titled "Further Exclusions from the Federal Labor-Management Relations Program," purports to enhance national security. The unions argued President Trump exceeded discretion under 5 U.S.C. § 7103(b) and that the conduct threatens to eliminate collective bargaining rights.
