Fox backed up McLaughlin's pitch with B-roll from protests in Portland five years ago, which President Couch Potato decided was an accurate representation of the situation on the ground today."
The president claimed ANTIFA ravaged a Portland immigration detention center, prompting plans to federalize forces. A Homeland Security spokesperson made misleading claims on Fox News, amplified with old protest footage. The Department of Justice produced a legal justification that included a falsehood to defend the deployment. The Ninth Circuit Court of Appeals now must determine whether the DOJ lie matters given that courts previously accepted the larger presidential claim. Earlier litigation produced a temporary restraining order finding statutory preconditions for federalizing the National Guard were unmet, including no invasion or rebellion and adequate regular forces.
