General Motors will pay $12.75 million to resolve a civil lawsuit alleging unlawful sale of OnStar subscribers’ personal information and driving data to third-party data brokers in violation of California privacy, false advertising, and unfair competition laws. The lawsuit alleges that from 2016 to 2024, GM collected and retained driver- and driving-related data from hundreds of thousands of Californians who subscribed to OnStar. The data allegedly included names, phone numbers, home addresses, speeds, rapid acceleration, hard braking, and GPS locations of where vehicles were driven and parked. The lawsuit also alleges GM told subscribers it did not sell driving or location data and that data would be used only for OnStar services. It further alleges that in 2020 GM began selling the data to LexisNexis Risk Solutions and Verisk Analytics without adequate disclosure.
