German tourist wins damages after sun lounger court battle
"Every day during the holiday all the loungers at the hotel's pool area were reserved with towels from six o'clock in the morning. The man and his family did not take the same approach and thus found it impossible to obtain a lounger by the pool for relaxing and sunbathing."
"Especially on such a trip, where spending time at or near the pool clearly plays a major role... travellers may also expect that a sufficient number of loungers will be guaranteed."
A German holidaymaker and his family booked a package holiday to Kos, Greece through TUI for over €7,000 in August 2024. Throughout their stay, other tourists reserved all pool loungers by placing towels on them starting at 6 a.m., preventing the family from accessing loungers for relaxation and sunbathing. Despite complaints to hotel staff and tour company representatives about violations of resort rules, no effective action was taken. A Hanover court ruled in the holidaymaker's favor, awarding €986.70 compensation—approximately 15 percent of the holiday cost. The court determined that guests should reasonably expect sufficient lounger availability at pool-focused resorts. TUI had previously offered €350, which the tourist deemed insufficient.
